Terms & Conditions
Terms & Conditions
Website use, enquiry and quote request terms for ATS.
Last updated: 11 August 2026
These Terms & Conditions apply to the Atlantic Technical Solutions (ATS, we, us or our) website and to enquiries or quote requests submitted through it. By using this website or submitting a form, you agree to these terms.
1. Website purpose
This website provides information about ATS services and allows visitors to contact ATS or request quotations for repair, maintenance, fabrication, finishing, field-service and related technical work.
Website content is provided for general information only. It is not a final technical assessment, quotation, warranty, promise of availability or binding service agreement.
2. Enquiries and quote requests
Submitting an enquiry or quote request does not require ATS to accept the work and does not create a binding contract. ATS may contact you to clarify the job, inspect the equipment, request further information or decline work that is outside scope, unsafe, unavailable or unsuitable.
You are responsible for ensuring that information submitted through the website is accurate, complete and authorised. This includes equipment details, fault descriptions, location information, photos, documents and contact details.
3. Quotations and acceptance
Any quotation issued by ATS is subject to the terms stated in that quotation and any written scope, expiry date, exclusions, payment terms or conditions included with it.
Unless stated otherwise in a written quotation:
- prices are based on the information available at the time of quoting;
- final scope may change after inspection, dismantling, testing or fault diagnosis;
- parts, materials, third-party services, travel, transport, call-out fees, storage, taxes or additional labour may be charged where applicable;
- work starts only after ATS accepts the job and any required authorisation, deposit, purchase order or written approval has been received;
- availability of parts, materials, staff, workshop capacity and field-service access may affect timing.
4. Service work and field support
ATS may provide workshop and field-service support depending on the nature of the job, site conditions, safety requirements, staffing, equipment access and availability.
For field-service work, the customer must provide safe and lawful access to the site, equipment and relevant information. The customer must disclose hazards, site rules, access restrictions, isolation requirements, dangerous goods, unsafe conditions or any other information that may affect the work.
ATS may stop, delay or refuse work where conditions are unsafe, access is restricted, the scope is materially different from what was represented, payment terms are not met, or required authorisations are missing.
5. Customer responsibilities
You confirm that you are authorised to request the work, submit the information and provide any uploaded files. You are responsible for:
- giving accurate contact, company, equipment and fault information;
- ensuring equipment is legally available for inspection or repair;
- removing valuables or unrelated personal items from equipment where appropriate;
- providing keys, access, permits, site inductions or safe working arrangements where needed;
- backing up or protecting any electronic data or settings that may be affected by repair, diagnostics or service work;
- reviewing quotations, scopes and invoices before approving work or payment.
6. Uploads and submitted content
You must not upload malicious, unlawful, confidential or unrelated material. You must not upload files that contain viruses, scripts, executable code or material that infringes another person's rights.
ATS may reject, delete or refuse to open unsafe or irrelevant uploads. Uploaded files are used only to assess, manage or respond to the enquiry or quote request, subject to the Privacy Policy.
7. Payments and invoices
Payment terms are those stated in the relevant quotation, invoice, written agreement or approved account arrangement. ATS may require deposits, progress payments, payment before release of equipment, or proof of payment before commencing or completing work.
Late, failed or disputed payments may delay work, release of equipment, delivery of documents or further service support, subject to applicable law and any written agreement.
8. Workmanship, parts and limitations
ATS aims to perform accepted work with reasonable skill, care and practical workmanship appropriate to the agreed scope.
Any warranty, if applicable, must be recorded in the quotation, invoice or written agreement. Warranties may not apply to customer-supplied parts, pre-existing defects, hidden damage, misuse, unauthorised repairs, wear and tear, unsuitable operating conditions, incomplete customer information, or work outside the agreed scope.
9. No guarantee of uninterrupted operation
Repair, maintenance, diagnostics and fabrication work can involve unknown defects, unavailable parts, hidden damage and operational variables outside ATS control. ATS does not guarantee that equipment will operate without future faults unless a specific written warranty says so.
10. Limitation of liability
To the maximum extent permitted by applicable law, ATS is not liable for indirect, incidental, special or consequential loss, including loss of profit, production, revenue, contracts, data, goodwill, use of equipment or business interruption.
Nothing in these terms excludes liability that cannot lawfully be excluded.
11. Website availability and accuracy
ATS tries to keep website information accurate and available, but the website may contain errors, omissions or outdated information. ATS may update, suspend or remove website content at any time without notice.
Service descriptions, images and examples on the website are general indicators of capability and may not represent every job, condition, price, part, process or outcome.
12. Intellectual property
The ATS name, logo, website text, layout, images, graphics and other website materials belong to ATS or its licensors unless otherwise stated. You may view and use the website for normal business enquiry purposes, but you may not copy, reproduce, scrape, modify or republish website material without permission.
13. Prohibited use
You must not misuse the website. Prohibited use includes attempting to bypass security, submit spam, upload malicious files, probe systems, interfere with availability, impersonate another person, submit false information, or use the website for unlawful purposes.
14. Privacy
Personal information, enquiry details, quote request details, uploads, analytics and security records are handled according to the ATS Privacy Policy published on this website.
15. Electronic communications
You agree that ATS may communicate with you electronically using the contact details you provide. Electronic communications, records and confirmations may be used for enquiry, quote, service, administrative and record-keeping purposes.
16. Third-party websites and services
Links to third-party websites or services are provided for convenience only. ATS is not responsible for third-party content, availability, terms, privacy practices or security.
17. Force majeure
ATS is not responsible for delay or failure caused by events outside reasonable control, including unsafe conditions, power or network failures, supplier delays, transport disruption, parts shortages, industrial action, extreme weather, fire, accident, emergency, government action or other force majeure events.
18. Governing law
These terms are governed by the laws of the Republic of Namibia, unless a written agreement between ATS and the customer states otherwise.
19. Changes to these terms
ATS may update these Terms & Conditions from time to time. The version published on this website applies from the date shown above.
